§ 1 Scope and provider
(1) These General Terms and Conditions (GTC) apply to all orders that you place via the online shop bmelectric.de.
(2) Your contractual partner is BM Trade, MB, M. K. Čiurlionio g. 84B-76, 03170 Vilnius, Lithuania, company code 305544877, email: sales@bmtradeco.eu (hereinafter “we”). Further information can be found in the legal notice.
(3) Deviating terms of the customer are not recognised unless we expressly agree to their validity.
§ 2 Conclusion of the contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer but an invitation to place an order.
(2) You choose the cross-section and length, add the product to the cart and proceed to checkout. There you enter your billing and delivery details and choose the payment method. Before submitting your order, you see all details again in an overview and can correct them using the usual keyboard and mouse input functions and in the cart. By clicking the “Buy now” button (German version: „Jetzt kaufen“), you submit a binding order.
(3) We confirm receipt of your order by email without delay. With the payment methods offered (credit/debit card, Apple Pay, Google Pay, PayPal), payment is triggered during the ordering process; the purchase contract is concluded with this order confirmation.
(4) The contract languages are German and English.
(5) We store the text of the contract and send you the order details and these GTC by email. You can access the GTC on this page at any time. If you have created a customer account, you can view your orders there.
§ 3 Prices and shipping costs
(1) All prices are final prices and include statutory VAT. The final price is the same in all delivery countries; the VAT included depends on the VAT rate of the country of delivery.
(2) We deliver to all member states of the European Union (except the Canary Islands, Ceuta and Melilla). Shipping costs per order are €4.90 for delivery to Germany (express shipping) and €9.90 for delivery to the other member states (standard shipping). From a goods value of €50 (Germany) or €100 (other member states), in each case including VAT after deduction of any discounts, we deliver free of shipping costs. Deliveries of 100 m coils to the other member states are excluded: shipping costs for these are €19.90 per order regardless of the order value, plus €10 for each additional 100 m coil. § 4 Delivery
(1) The goods are shipped by our logistics service provider from a warehouse in Germany. The delivery time after conclusion of the contract is 1–3 working days for delivery to Germany and 3–5 working days for delivery to the other member states, unless otherwise stated for the product.
(2) If an ordered product is not available, we will inform you without delay and immediately refund any payments already made.
§ 5 Payment
(1) You can pay by credit or debit card, Apple Pay, Google Pay or PayPal. Which payment methods are displayed may depend on your device and browser.
(2) The invoice amount is due upon completion of the order and is charged by the respective payment service provider.
§ 6 Retention of title
The goods remain our property until they have been paid for in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. For details, see our cancellation policy.
§ 8 Warranty
The statutory rights for defects apply. Please report obvious transport damage to the carrier and to us as soon as possible; your statutory rights remain unaffected.
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and to the extent of any guarantee we have assumed.
(2) In the event of a slightly negligent breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
§ 10 Use of the products
The cables are intended for fixed installation indoors. Electrical installations may only be carried out by a qualified electrician in compliance with the applicable standards.
§ 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
